Subject:
Seniority List of officers in the grade of Commissioners [Grade-II of
IRS (C&CE)] as on 01.01.2009 - Final Seniority List.
Sir/
Madam,
I
am directed to say that the draft Seniority List of the officers in the grade of
Commissioner [Grade-II of IRS (C&CE)] was circulated vide letter of even
number dated 11.02.2009, inviting submission of objections (if any) from the
officers by 28.02.2009.

The objections submitted by the officers have been verified with
reference to the Service Records of the officer, maintained in the Board Office
as also in the Office of the concerned Chief Commissioner.
After such examination, necessary corrections have been made in the draft
Seniority List in respect of the name of the officer, date of birth, category,
date of regular appointment to the grade, etc., wherever the objection filed by
the officer was found to be correct on checking with the records. Some officers filed objections regarding their inter-se
seniority with reference to other officers, which have not been found correct,
as the seniority has been reflected precisely in the order in which the officers
were recommended for promotion through DPCs convened in UPSC.
In such cases, the objections appear to be due to lack of complete
information with the officers concerned. The
position is being informed to the individual officers concerned separately.

Some officers have claimed change in seniority on the basis of Order
dated 29.03.2007 passed by Hon’ble CAT, Principal Bench, New Delhi in OA
No.2456/2003 and 2072/2004. These
Orders have been challenged by the Department before Hon’ble Delhi High Court
by way of Writ Petition No.1762/2007, which is pending.
Hence, any decision in this regard can be taken only after the matter is
finally settled.

Accordingly, the final Seniority List has been drawn up and a copy of the
same is enclosed herewith for information.
The Seniority List will be subject to outcome of Writ Petition
No.1762/2007 pending before Hon’ble Delhi High Court.
